Arguments Presented to Supreme Court Regarding Allegations of Secrecy Disclosure

Álvaro García Ortiz's defense seeks to dismiss case related to allegations against Alberto González Amador, partner of Madrid's regional president.
The defense team for Álvaro García Ortiz, the Attorney General of Spain, has formally requested that the Supreme Court dismiss the legal proceedings concerning alleged disclosures of secrets involving Alberto González Amador, partner of Isabel Díaz Ayuso, President of the Community of Madrid.

The allegations follow claims of tax fraud against González Amador.

In a written submission to the Second Chamber of the Supreme Court, the defense argues that the case reflects a 'carefully orchestrated procedural strategy' aimed at presenting a distorted version of events.

The defense contends that the allegations selectively omit pertinent information that could counter or contextualize the incriminating narrative, portraying González Amador merely as a private individual despite his public prominence linked to his relationship with Ayuso.

The defense maintains that the information regarding prior communications with the Prosecutor's Office was disclosed due to González Amador’s notable public status and relationship with Ayuso.

They assert that the claims have been constructed to misleadingly shift suspicion toward the Attorney General.

Additionally, the defense points to González Amador's close associates as potential sources of information concerning emails in which he supposedly acknowledged two tax offenses and document falsification.

The document states, 'It is highly plausible that the information contained in the email of March 12, 2024, as well as that of February 2, 2024, were known to journalist Esteban Urreiztieta Núñez through González Amador himself or his immediate circle.'

García Ortiz's defense argues that the inquiry has failed to substantiate any accusations against him and emphasizes that by the time García Ortiz accessed the disputed information, it had already been made public and verified by journalists and other third parties, suggesting that the events in question lack criminal relevance.

The defense also highlights contradictions in González Amador's statements regarding his negotiations with the Prosecutor's Office, claiming they compromise his credibility and necessitate caution in assessing the truthfulness of his testimony.

Concerning the deletion of data from García Ortiz's mobile device, the defense asserts that this action was both legitimate and compliant with data protection rights, declaring, 'The deletion of data from my client's mobile device not only constitutes a legitimate and meticulous act regarding data protection rights but in no case serves as an indication of involvement in any criminal act.'
