Spanish Supreme Court Judge Links Government Presidency to Data Leak Involving Madrid President

Judicial proceedings against Spain's Attorney General implicate high-level government officials in a sensitive information leak case.
The recent judicial ruling by Supreme Court Judge Ángel Hurtado has drawn attention to possible involvement from the Presidency of the Government in the unauthorized dissemination of sensitive information regarding the partner of Isabel Díaz Ayuso, the President of the Community of Madrid.

The judge asserts that Álvaro García Ortiz, the Attorney General, acted under directives from government officials at Moncloa, the official residence of the Spanish Prime Minister.

In the ruling, Hurtado specifically notes that the complete information regarding a proposed agreement by businessman Alberto González Amador, who sought to confess to tax offenses, was leaked 'following instructions received from the Presidency of the Government.' The judge elaborated that prior to any media report, the General Prosecutor's Office sent a copy of the email detailing the agreement request to Pilar Sánchez Acera, an aide to the current Minister for the Presidency, Óscar López.

According to the magistrate, upon receipt of this information, Sánchez Acera instructed Juan Lobato, the spokesperson for the Socialist parliamentary group in the Assembly of Madrid, to present the information during a session on March 14. This action appears to have been aimed at politically undermining President Ayuso.

Part of the judicial inquiry included testimony from Juan Lobato and consideration of Pilar Sánchez Acera as a witness.

Although the judge did not proceed to formally charge her, he expressed skepticism towards her testimony, noting that she could not specify the origin of the email containing information about Ayuso's partner.

Sánchez Acera stated she did not remember the circumstances and no longer had records of related communications.

Further compounding the case are findings related to the mobile phone of Juan Lobato and a notarial record prepared by the former Secretary General of the Madrid PSOE.

The judge contends that it has been substantiated that the General Prosecutor's Office forwarded the communication in which Ayuso's partner's lawyer proposed to confess to two tax crimes in an effort to reach a plea agreement.

The deletion of messages from the Attorney General's computer, in addition to his WhatsApp communications, undermines García Ortiz's defense.

If, as both the Attorney General and Moncloa claim, the emails were never sent from the Public Prosecutor's Office to the Presidency, they are unable to verify this due to the missing records.

The deletion and change of devices have raised suspicions of an attempted cover-up that further complicates the position of the Attorney General.

Pilar Sánchez Acera’s involvement has been highlighted by the judge based on multiple messages that contributed to his conclusions.

Hurtado points to Lobato’s responses during the inquiry, particularly his assertion in a WhatsApp message that the infamous email originated from the Prosecutor's Office.

Furthermore, there were instances where Lobato showed uncertainty regarding whether the information had been published by any media outlet, requesting confirmation on this point.

As the judicial procedures unfold, the ramifications of this case are expected to resonate through Spain’s political landscape, creating scrutiny over the intersection of governance and legal authority.
