Spanish Prosecutor's Office Appeals Ruling Against Chief Prosecutor

In a document obtained by media outlets, María Ángeles Sánchez Conde, the Deputy Prosecutor of the Supreme Court, is appealing directly to the Appeals Chamber, bypassing the option for a review by Hurtado.

The appeal requests the closure of the case and the exoneration of the two prosecutors involved.

It is argued that the judge himself acknowledged that prior to the alleged leak of an email dated February 2, 2024, news related to a supposed offer of settlement by González Amador already circulated in the media, which purportedly involved acknowledgment of two tax crimes.

Sánchez Conde details that agents from the Central Operative Unit (UCO) of the Civil Guard testified that multiple individuals were aware of the existence of this supposed settlement offer before the email was sent to the Attorney General.

Several journalists reportedly confirmed they possessed information about the email dated February 2, 2024, before it was sent to García Ortiz.

The appeal criticizes Hurtado for using a reductive argument, suggesting that the only possible 'legal sources' mentioned by a media outlet regarding the 'email' could be the Prosecutor's Office or González Amador's lawyer, which was dismissed based on testimony from the lawyer, Carlos Neira.

It was also established that the email had been sent to the State Advocacy the same day it was sent to García Ortiz.

Sánchez Conde emphasizes that this information was known, specifically, to Almudena Lastra, the head of the Superior Prosecutor's Office of Madrid, who alerted García Ortiz to circulating misinformation before the email reached him, asserting that she knew it was false.

The Prosecutor's Office counters Hurtado's assertion that refuting the information published by _El Mundo_ on March 13, 2024, at 21:29 hours was irrelevant.

Sánchez Conde argues that it is significant that the publication mentioned non-existent orders to withdraw the purported settlement agreement offered by the Prosecutor’s Office to González Amador, which had never taken place.

She contends that the urgency was to clarify the Prosecutor’s correct conduct amidst false claims that implicated the institution in unusual behavior for political reasons.

Additionally, the UCO agents acknowledged that they had found no evidence to confirm that the leak originated from García Ortiz, nor was there evidence of collusion between him and Rodríguez concerning the alleged leak.

Sánchez Conde further criticizes Hurtado for what she describes as serious omissions in his narrative and points out that he introduced allegations of directives from the Government Presidency involving the Attorney General without any foundational evidence, leading to a significant violation of the rights of the individuals being investigated.

She claims that no evidence has been offered to substantiate or dismiss this claim and that neither of the accused was asked or informed of such an accusation.

In her appeal, Sánchez Conde asserts that this pattern exemplifies a failure to uphold the procedural and constitutional guarantees that should govern such an inquiry.
