Ex-MP Íñigo Errejón Faces Judge Over Sexual Assault Allegations

Ex-MP Íñigo Errejón Faces Judge Over Sexual Assault Allegations

The case involving the former spokesperson of Sumar and actress Elisa Mouliaá returns to court after initial closure and reopening.
On Thursday, former Spanish MP Íñigo Errejón and actress Elisa Mouliaá are scheduled to appear before Madrid's Court of Instruction Number 47. The session marks Errejón's first public appearance since his resignation following anonymous allegations of sexual violence against an unnamed Madrid politician surfaced via social media.

These allegations, initially shared by journalist Cristina Fallarás, sparked a significant public discourse, although they did not directly name Errejón.

Subsequent to these revelations, Errejón published a letter announcing his withdrawal from politics.

Acknowledging his ongoing struggle with personal issues and societal pressures, he characterized himself as a victim of both political and media bias.

The Allegations

Elisa Mouliaá, at present, stands as the sole individual to have filed a formal complaint against the former politician which has been admitted for judicial review.

Her allegation came on the same day as Errejón's political resignation.

Mouliaá described an occasion after meeting Errejón through social media, where both attended a party at a friend’s house.

She alleges that during the gathering, Errejón made unwanted advances and physically confined her in a room, proceeding to touch and kiss her without consent.

The situation allegedly escalated at Errejón’s residence, resulting in Mouliaá confronting him over his inappropriate behavior.

Legal Proceedings and Changes

Mouliaá has acclaimed three different attorneys throughout the case, including Carla Vall, a well-known Catalan lawyer with expertise in cases of sexual assault and gender-based violence.

After Vall requested postponement due to maternity leave, the case was initially archived by Judge Adolfo Carretero.

However, this decision was contested by Eva Gimbernat, Errejón’s legal representative, leading to a reopening of the case in December following a judicial reconsideration.

Courthouse Protocol and Strategies

To maintain procedural integrity in sexual assault cases, courthouse protocols mandate separate timings for appearances by the accuser and the accused to avoid any potential interaction.

Thus, the court has scheduled Mouliaá's appearance at 11 a.m. and Errejón’s at 12:30 p.m., with the latter contingent upon the duration of Mouliaá's statements.

Errejón's defense is expected, based on recent communications, to present a narrative differing from Mouliaá’s account.

Gimbernat has signaled intent to refute the actress’s allegations as inconsistent and weak.

Conversely, Mouliaá's counsel, led by Alfredo Arrién Paredes, plans to substantiate her claims, highlighting the psychological trauma experienced, and possibly calling additional witnesses from the event in question and Mouliaá’s therapist.

Potential Legal Maneuvers

Errejón’s legal team sought to delay his testimony until Friday, enabling time to thoroughly review Mouliaá's declarations, a request not granted by the magistrate.

However, Errejón may exercise his right not to testify on the scheduled date, potentially opting for a voluntary appearance at a later stage after reviewing the testimonies provided.

Amidst a backdrop of shifting narratives and legal strategies, the courtroom proceedings on Thursday will play a critical role in shaping the continuance and focus of this controversial case.
