Gibraltar Border Inspector's Case Dismissed Amid Ongoing Tensions

Gibraltar Border Inspector's Case Dismissed Amid Ongoing Tensions

The dismissal follows a controversial attempt to enforce stricter passport controls at the Gibraltar border.
The border between Gibraltar has seen a return to relative calm over the past three weeks, following a series of tensions that have impacted the daily transit of approximately 20,000 individuals between Spain and the United Kingdom.

The tranquility comes after the court in La Línea de la Concepción decided to archive the case against David Barrero, the chief border inspector, who had been suspended since February 26. Barrero's case was focused on allegations he made against his superiors regarding prevarication and coercive practices.

He filed his initial complaint on November 22, coinciding with his unilateral decision to reinstate passport stamping, which had previously caused significant disruptions at the border.

The chief inspector's decision to tighten controls came after he had served in the role since 2022 without incident, raising questions within the police community about the sudden changes in approach.

Barrero's actions sparked a backlash, with colleagues in the Sindicato Profesional de la Policía (SPP) expressing their concerns over leadership decisions and support for the local commissioner Maria José Martínez.

Recently, La Línea's Judge Alba Serrano ruled in favor of the defense presented by the Interior Ministry and the National Police, stating that Gibraltarians, who possess a red identity card, were exempt from the requirement to have their passports stamped due to the changes in the UK’s relationship with the EU since Brexit.

This decision effectively endorsed the current system of border control management.

Barrero has publicly expressed his intention to appeal the court’s decision, which aligned with the administrative stance of the local, provincial, and general police authorities.

He has argued that the existing border controls were insufficient and created security risks that warranted the reintroduction of passport stampings.

The policing authority suspended Barrero following his public statement about increasing border control measures on February 21, after which there were concerns about potential public order risks.

Subsequently, Barrero faced five months and half of suspension from active duty.

He is currently barred from his responsibilities as a result of this disciplinary action.

There are indications that further sanctions could follow as the local police union cited potential removals related to other disciplinary breaches.

The incident reflects growing tensions within the critical border area, characterized by ongoing disputes over labor relations and political ramifications.

As the border operates with 112 police officers managing a sensitive crossing, the standoff has led to rising concerns regarding its impact on the bilateral relations between Spain and the UK, notably regarding long-pending discussions about a treaty for Gibraltar.
