Supreme Court Proceedings Against Spain's Attorney General Accelerated by Testimony

Alberto González Amador, partner of Madrid's president, set to testify in a case involving unauthorized disclosure of confidential information.
The Supreme Court of Spain is poised to advance the proceedings against ÁLVARO GARCÍA ORTIZ, the Attorney General, as a result of the impending testimony from ALBERTO GONZÁLEZ AMADOR, partner of Madrid's regional president ISABEL DÍAZ AYUSO.

GONZÁLEZ AMADOR is at the center of an investigation regarding unauthorized disclosure of his sensitive information, which pertains to an ongoing inquiry into tax fraud.

Legal sources indicate that a decision on GARÇÍA ORTIZ's prosecution could come as early as next week.

The presiding judge in this case, ANGÉL HURTADO, currently has a petition from the ASOCIACIÓN PROFESIONAL E INDEPENDIENTE DE FISCALES (APIF) pending, which seeks to officially process the case against García Ortiz for the alleged unauthorized revelation of confidential information.

This request awaits completion of certain final proceedings.

Last week, agents of the Central Operational Unit (UCO) of the Civil Guard appeared before the Supreme Court, presenting their findings that implicate García Ortiz as having a “preeminent” role in leaking GONZÁLEZ AMADOR's correspondence from February 2, 2023, where he acknowledged potential tax fraud and expressed willingness to negotiate with the Public Prosecutor’s Office.

With these claims substantiated, the remaining step is to hear GONZÁLEZ AMADOR's statement as the plaintiff.

The Spanish State Attorney's Office has repeatedly called for this hearing to defend both García Ortiz and another implicated figure, Madrid's Chief Prosecutor PILAR RODRÍGUEZ.

Initially opposed by the judge, the order for GONZÁLEZ AMADOR's testimony was ultimately mandated by the Criminal Chamber of the Supreme Court.

Following GONZÁLEZ AMADOR's testimony, Judge Hurtado will be positioned to make determinations regarding the Attorney General’s prosecution, which in this context involves shifting the proceedings to a shortened format similar to formal charging.

Legal sources suggest that both the request from APIF and GONZÁLEZ AMADOR's defense will reinforce calls for formal charges post-testimony.

Some requests for further investigations remain.

GONZÁLEZ AMADOR's representation seeks to explore the creation timeline of a document which García Ortiz forwarded to PILAR RODRÍGUEZ shortly after midnight on March 14, as well as any alterations made to that file.

On a parallel front, APIF wishes to ascertain whether García Ortiz's mobile agenda includes a contact number for PILAR SÁNCHEZ ACERA, the deputy head of the PSOE in Madrid, who directed the critical email dated February 2 to JUAN LOBATO, then leader of the Madrid Socialists.

While the judge has downplayed her involvement in the leak, his skepticism towards her testimony remains.

The judge may address these additional procedural requests simultaneously with the order moving to a simplified prosecution procedure, potentially leading to evidence collection during the trial phase.

In the context of the Federal Attorney General’s office, it is recognized that Judge Hurtado is likely to determine prosecution post-GONZÁLEZ AMADOR's declaration.

However, should this occur next week, such a ruling would occur during the XXXII assembly of the Ibero-American Association of Public Prosecutors in Madrid, where García Ortiz is set to host attendees from across Ibero-America and the European Prosecutor’s Office.
