Spanish Prosecutor Calls for Dismissal of Case Against David Sánchez

Spanish Prosecutor Calls for Dismissal of Case Against David Sánchez

The Prosecutor's Office cites lack of evidence in investigation linked to the brother of the Prime Minister.
The Prosecutor's Office of Badajoz has requested the Badajoz Court to dismiss the ongoing investigation into David Sánchez, the brother of Prime Minister Pedro Sánchez, concerning his hiring at the provincial council.

The public prosecutor expressed that there are no indications of criminal activity to substantiate allegations of misconduct, including prevarication and influence peddling.

The request indicates that the inquiry relies on conjectures and hypotheses rather than tangible evidence.

In a formal submission containing over 100 pages, the prosecutor called for the revocation of the order issued by Judge Beatriz Biedma of Badajoz's Investigating Court No. 3, who has led the investigation.

The prosecutor emphasized that the accusations posited by the judge, suggesting that the position held by Sánchez at the Badajoz Conservatory was created specifically for him, lack credible evidence of a crime.

The prosecutor argued that extending this investigation is futile, asserting that it is lacking authentic rational indications of criminality necessary to proceed against David Sánchez and ten others implicated in the case, including Badajoz Provincial Council President Miguel Ángel Gallardo.

The prosecutor's position suggests a closure of the investigation given the absence of evident criminal conduct.

The demand for closure comes shortly after a popular accusation, led by the ultra-right Vox party and the People's Party (PP), called for a three-year prison sentence for David Sánchez and Gallardo, alongside demands for Sánchez to reimburse salaries earned during his time at the conservatory.

In response to the prosecutor's filing, the Ministry of Digital Transformation, represented by minister Óscar López, stated that the case arose from a complaint made by an ultra-right organization and characterized the claims as part of a smear campaign against the government.

López defended the administration's integrity, emphasizing that the government will continue to function despite challenges from opposing political factions.

Gallardo, a participant in the investigation, asserted his confidence in the process, stating that justice would prevail and characterized the inquiries as politically motivated attacks orchestrated by right-wing entities.

The PP's congressional spokesperson, Miguel Tellado, echoed sentiments of skepticism regarding the prosecutor's request, suggesting it reflects political influence over judicial matters.

Tellado highlighted previous statements from Prime Minister Sánchez regarding the independence of the prosecutor's office, insinuating a lack of impartiality in handling the case.

The far-right organization Manos Limpias, reacting to the prosecutor's request to archive the case, issued a statement arguing that the decision exemplifies the politicization of the judiciary and highlights a failure of the legal framework.

They criticized the prosecutor for what they described as inadequate defense of the accused parties.
